今夜時間ある？
と言っても大丈夫です。
1. This question asks if this person is occupied later.
2. this question askes if this person is busy later.
3. To free up some time = to make time to do something.
This person may have already made an arrangement for this evening. However, they may be able to 'free up' some time and get away for a period.
